Mediation Services
Mediation is the process of intervening in a dispute with the aim of resolving the dispute and reconciling the disputing parties. The mediator takes a neutral position between the disputing parties to help them resolve the issues that separate them.
Mediation cases can involve civil, commercial, family, workplace, school, faith or other areas. Some mediation services cover several of these. Mediation is one form of Alternative Dispute Resolution (ADR). The name refers to a process which is an alternative go going to court. In some countries the courts require that parties go through an ADR process first, before coming to court. ADR processes include conciliation, adjudication and arbitration as well as mediation. Mediators need to be trained. Their main skill is in being able to listen to and understand the feelings of both parties to a dispute. The mediation skills involved can vary between different mediation areas.
Mediation is different from Restorative Justice in that RJ only applies when one party has suffered at the hands of the other and the offender has admitted their guilt.
